1. Who these terms apply to
These Terms and Conditions apply to every person who books, attends or participates in a Grounded Grappling camp, class, open mat, social activity, meal, accommodation arrangement or related event. “Grounded Grappling”, “we”, “us” and “our” refer to the organisers of the event.
By purchasing a ticket, accepting a transferred ticket, attending camp or participating in an activity, you confirm that you have read and accepted these terms.
2. Nature of the camp and assumption of risk
Grounded Grappling is a Brazilian Jiu-Jitsu camp. Activities may include grappling, drilling, sparring, rolling, mobility work, strength or conditioning activities, hiking, campfire activities, shared accommodation, food service and other recreational or social activities.
You understand that Brazilian Jiu-Jitsu is a contact sport and that participation carries inherent and obvious risks. These risks include, without limitation, strains, sprains, bruising, cuts, dislocations, fractures, concussion, neck or spinal injury, illness, allergic reaction, permanent injury and, in extreme cases, death.
You voluntarily accept the ordinary and inherent risks of participating. You are responsible for deciding whether an activity is suitable for your experience, health, fitness and personal circumstances. You may sit out any activity at any time.
3. Health, fitness and medical matters
You must not participate if you are injured, unwell, affected by alcohol or drugs, or otherwise unable to participate safely. You must disclose relevant injuries, medical conditions, allergies and dietary requirements when reasonably requested.
You are responsible for obtaining medical advice before attending if you have any doubt about your ability to participate. Grounded Grappling staff and coaches are not providing medical advice.
In an emergency, you authorise us to seek first aid, ambulance or medical assistance where reasonably necessary. You remain responsible for any medical, ambulance or related costs not covered by insurance.
4. Participant conduct and safety
You must follow reasonable instructions from coaches, organisers, venue staff and emergency personnel. You must train with control, respect taps immediately, use techniques appropriate to the session and avoid reckless, dangerous, abusive or antisocial behaviour.
We may remove a person from an activity or the camp if we reasonably believe their conduct creates a safety risk, disrupts the event, damages property, harasses another person or breaches these terms. No refund is required where removal results from the participant’s conduct.
5. Release, limitation of liability and indemnity
To the maximum extent permitted by law, you release Grounded Grappling, its organisers, coaches, contractors, volunteers, venue operators and representatives from claims arising from the ordinary and inherent risks of recreational activities at camp.
To the maximum extent permitted by law, our liability is limited to the remedies available under applicable law. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for reckless conduct or rights and guarantees that apply under the Australian Consumer Law.
You indemnify Grounded Grappling against reasonable loss, damage, cost or claim caused by your unlawful, reckless or negligent conduct, your breach of these terms, or damage you cause to the venue or another person’s property. This indemnity does not apply to the extent the loss was caused by Grounded Grappling’s own negligence, breach of law or reckless conduct.
6. Bookings and payment
A booking is confirmed only when payment has been received and we have accepted the booking. Tickets are personal to the attendee unless a transfer is approved under section 8.
You are responsible for providing accurate booking, dietary, accommodation and contact information. Prices and inclusions may be corrected where a genuine error has occurred before acceptance of the booking.
7. Refund and cancellation policy
Camp tickets are final. We do not guarantee a refund because you change your mind, become unavailable, are injured, miss transport or can no longer attend.
Where Grounded Grappling agrees to provide a discretionary refund, the refund will be the amount paid less an 8% merchant and administration fee. Any discretionary refund must be confirmed by us in writing.
This policy does not limit any refund, replacement or other remedy you may be entitled to under the Australian Consumer Law.
8. Ticket transfers and the waitlist
You may request to transfer your ticket to another suitable attendee at no cost. We are also happy to try to match your ticket with someone on the camp waitlist. A transfer is not complete until Grounded Grappling confirms the new attendee and receives any required contact, medical, dietary and accommodation information.
We cannot guarantee that a replacement attendee will be available, and the original ticket holder remains responsible for the booking until the transfer is confirmed.
9. Rolling a ticket to a future camp
If you cannot attend, we are generally happy to consider rolling the value of your ticket to the next Grounded Grappling camp, within reason. Rollovers are subject to our approval, availability, timing of the request, the reason for the request and the pricing and format of the future camp.
A rollover is a credit, not a cash refund. If the future camp costs more, you must pay the difference. If it costs less, no cash balance is payable unless we agree otherwise. Requests should be made as early as possible by emailing admin@groundedgrappling.com.
10. Changes, postponement and cancellation by us
We may make reasonable changes to coaches, timetable, meals, accommodation allocations, activities or facilities where necessary. Advertised details are indicative and may change due to coach availability, safety, weather, venue requirements or circumstances outside our control.
If we cancel the entire camp and do not offer a suitable replacement date, attendees will receive a refund of the ticket price paid. We are not responsible for indirect costs such as flights, fuel, accommodation booked elsewhere, lost income or other travel expenses, except where required by law.
11. Accommodation, property and venue rules
Camp accommodation is shared and may include bunk beds and shared bathrooms. You must respect room allocations, quiet hours, fire safety requirements and all reasonable venue rules.
You are responsible for your belongings. Grounded Grappling is not responsible for lost, stolen or damaged personal property except where caused by our breach of a non-excludable legal duty.
12. Food, allergies and dietary requirements
We make reasonable efforts to cater for disclosed dietary requirements. However, shared kitchens and food preparation areas may contain allergens, and we cannot guarantee an allergen-free environment. Participants with serious allergies must notify us before camp and bring any required medication.
13. Photography and recordings
Camp activities may be photographed or recorded for the camp video library, social media and Grounded Grappling promotion. If you do not wish to appear in promotional material, tell an organiser in writing before camp and remind us when you arrive. We will make reasonable efforts to respect your request.
14. Minors and families
A parent or legal guardian must book for and supervise any participant under 18 unless we expressly agree otherwise. The parent or guardian accepts these terms on the minor’s behalf and remains responsible for the minor’s conduct and welfare.
15. Consumer law
These terms are intended to operate only to the maximum extent permitted by law. Nothing in them excludes, restricts or modifies a consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified.
16. Governing law and severability
These terms are governed by the laws of Victoria, Australia. If any part of these terms is invalid or unenforceable, that part will be read down or severed and the remaining terms will continue to apply.
